Grandfather’s ancestral property dispute

Hi, My grandfather is alive right now and he is actually causing problem for us to stay in his house after my mother’s death. Me and my brother want to know that can we claim the rights on the property even if he has written down all the property under my father’s name in his will.

will comes into effect after the death of the maker of the will. if it is an ancestral property, you may claim your share in it. moreover, if it is an ancestral property, your grandfather can give away only that part which falls in his share.

If the property is an ancestral property then you can claim partition, if it is not and it's a grandfather's self acquired property then you can not seek any remedy against him. Figure out the nature of the property that is under your grandfather and then decide.
