Grandfather has 5 acre land 3 sons 3 daughters how will it get divided

My grandfather have 5acers of land he 3son and 3daughter he was dead in 1976 we do not share the property till now we decided to shareing all 5members are ready one of her daughter is not agreed and decided to put case is possible to make our property divided without her present

Any or all of those who are ready and want partition of the estate of the deceased may approach the court with a suit for partition making those who do not agree for partition or who do not want to join those who file the suit for partition as defendants/opposite parties.
son, daughter, widow, mother are mainly the successors to the estate of the deceased. For details you may refer to schedule and also section 8 of the Hindu Succession Act, 1956.

sir, you are not informing about direct issues of your grand father you are hindu or not and as your information he was died in 1976, as per new amendment on hindu succession act ,if father alive on the date of implementation of the act than only daughters have share, will not that condition they can not claim for any thing as per new act.
