GPA_validity_after_death_of_one_of_the_3_executants

Our ancestral property is still in my father's name. His legal heirs are myself. my mother and my sister. Few months back, my father, mother, and sister together executed a registered GPA appointing me full rights of the property. Now, my father has passed away. Can I get property registered in my name using that GPA ?

Firstly, confirm whether the GPA is registered or unregistered and what are the clauses mentioned in that.


It depends on the clauses and the deed by that we can tell you whether you can execute the said property in favour you or not.

As per your query it is your ancestral property and few months back your father had execute a GPA before his demise wherein the GPA will stand if the GPA has mentioned clause stating that this GPA is irrevocable and final then you can get property registered in your name. If the said clause is not mentioned then you can't transfer the property in your name. Another way to transfer the property in your name is to execute a registered Release Deed in your name executed by your family members.
