GPA registered in sub registrar office. Need help
02-Jan-2023 (In Property Law)
Hi,
We have purchased a land in 1995 through GPA which is registered in sub registrar office.
We don't have sale deed. We just applied the EC and noted that In 2011 year the original seller has again sold the property to another person.
We have the Katha on our name. The office has issued the Katha based on the GPA document.
Please guide.
I advise you to immediately obtain all latest revenue documents pertaining to the property such as khata, tax paid receipts and other documents depending on the classification of property and then file a Declaratory suit asking the Court to declare you as the true owner. You will have to make the earlier owner and the new alleged owner (sale of 2011) parties. It would be advisable to do it soon as already 8 years have lapsed since the second sale.
yes if you have the khata and original GpA where is the sale deed it also has to be with you, now if you do not have the sale deed apply for the certified copy of it in sub register office, the second sale deed of original seller is null and invalid, if you are having possession of property do nothing , if you are not having possession you have to file case for possession based on the fact that as per the sale deed of 1995 you are the owner.
