GPA Holder Dies, What to do now?
03-Aug-2023 (In Property Law)
My father bought a residential property from "A" in an unauthorized colony in Delhi (which is being now authorized by the Govt.) with the following documents: GPA (Registered), WILL (Registered), AFFIDAVIT & Agreement To Sell (Notarized).
My father died last month, what am i supposed to do now?
What are the valid documents from the above mentioned documents now?
What would be the steps involved towards the transfer of the property right to my mother's name?
Please advice for the same. You can directly contact me at [email protected].
What is the difference between a GPA and a sale deed?
Only registered deeds can provide legal backing for property transactions. GPA transactions are not sanctified by law. GPA is not a legal title for property transactions; its recommended to use a registered deed.
Is sale through GPA valid?
A general power of attorney is not valid to transfer title to a property when buying or selling. Transferring property titles requires a sale deed, after which the buyer must pay stamp duty and other registration fees. 9 Feb 2022
