Hindu - My mother in law has gift deed with no consideration her property to my husband 13 years back and 2 years back my husband passed away now will my mother in law also become as legal heir for her share or not or should she make release deed in favour of me for the transfer of the property
Hello,
As mentioned by you in the above mentioned question yes your mother in law still holds her share in the said property as being the mother she holds the right the right of share in sons property.
The Hindu Succession Act, which lays down rules of succession and inheritance among Hindus in India, says that if a man passes away without leaving a will, his property will be equally distributed among his widow, his children and his mother.
Yes to release her share from the property you have to make a release deed. Wherein you will be 100% owner of the said property
