Father died interstate original deed missing after giving fir obtained certify copy after mutation my mother and mine name. Mother will like to gift deed but we have only certify copy . but lawyers in bangalore keep asking for the orignal deed. please clarify can my mother gift deed using certified copied.
Yes, she may gift the property on the basis of certified copy of the deed. For registration and for the purpose of registration one has to clarify the situation in the document that original copy is not available and accordingly the same will be done.
