Getting Ancestral Property From GrandFather's brother who had no child

17-Jul-2023 (In Property Law)
Hi, The situation is like that... Brother of grandfather who was unmarried and also had no legal heir died, but before his death he made a notary document of his plot and gave his plot to his brother's one of the grandson. Now that person is dead. That grandson is having the notary document which stats that his deceased grandfather is plot should be given to him. So does the grandson has legal right over that plot ? can some other family members challenge it in court ?

No legal right can accrue through that notary document, it creates no rights and title over the document. It’s a voidable document carrying no legal sanctity, and if required it can be challenged, unless the party projects it as a Will and states that the same was executed in presence of witness, then in that case the Modus operandi will change.

on the above mentioned query please note down that if anyone dies interstate and without legal heirs then the nearest relative gots right on the property. the grand children also can claim legal rights on the property
