Freehold property but map not passed

Hi Sir, In Delhi I am going to buy a resale house. Its on third floor. When I checked with dealer he said that the plot is freehold but third floor map is not passed. So they are selling in half rate. He said that seller had bought terrace rights 20 years back and then build a house on it. But at that construction on third floor was not allowed. Its a 20 years old house and area is also very developed. Dealer said registry will be done im your name for roof/sky rights. Is it safe to buy?

Would advise you to Seek a detailed Consultation for your query. Legal verification and perusal of the title deeds of the property is required to tender the considered opinion to you as to weather the property is Safe to Buy or not.

You can but the Propety n interest will be created but then as it’s not constructed with sanctioned map therefore MCD can demolish it anytime and they hold such powers ! It’s better u hire expert advocate for documentation
