Fraud property delaer who denied to return money

The person who is real estate and housing property broker took money from us on the basis of booking amount in 2016. And didnt make our deal for the same property and denied to return back money to us.
Accordingly one legal notice we gave to him but he did not took any action over it.ow what step we take?

collect all the paper document of the dealing done with the broker. if if money is paid through cheque or through neft, rtgs instead of cash, then will be easier for to file criminal case against broker.. You can even file civil case against for recovery of amount but this will take some time..
