FORMATION OF SOCIETY & CONVEYANCE
24-Apr-2025 (In Property Law)
LAND BELONGS TO A GROUP OF 55 PEOPLE BUT TITLE HAS ONLY 5 NAMES AND A MOU IS DOCUMENTED. NOW WISH TO GO FOR DEVELOPMENT AND WOULD LIKE TO KNOW SOCIETY FORMING AND GETTING CONVEYANCE IS ADVISABLE BEFORE GOING FOR DEVELOPMENT?
Yes, it is advisable for the society to be formally constituted and for conveyance to be obtained in its name before proceeding with development. Although the MOU may reflect intent, legal ownership must be clear. Since the title is in the names of only 5 out of 55 individuals, it is important to have a registered conveyance deed in favor of the society or a legal entity representing all 55 members. This ensures clarity of title, avoids future disputes, and is essential for approvals from authorities for development. Legal due diligence and proper documentation are crucial before moving forward.
