Formation of Flat Owners Association

Out of 208 flats in a Housing Complex around 100 sold.The builder is not allowing formation of Flat Owners Association as the majority of flats not sold and charging maintenance and doing the maintenance. We would like to form the flat owners association and take charge of maintenance and the charges.Can we do that ?
West Bengal Apartment Ownership Act, 1972, to enable housing associations to form a federation, to take care of the maintenance and management of common areas and facilities for all in an apartment society. In your case you can certainly do that and form the association and take over the control and do it more democratic way. Many of my clients got relief this way. All the best and regards
