Flat registration after death of owner without nomination

26-Dec-2023 (In Property Law)
My husband purchased a Flat in the Co-operative Hsg. Society and after 4 years passed away without making any nomination. Now, since I am his wife and sole beneficiary to this flat, how to go about this process of making a new registration in my ( wife's) name. Thanks for your advice in advance. Rgds Mrs. Vinod M. This is my response to you: 1. Nomination does not transfer title; 2. After death of your husband class I legal heirs become the owners of the flat; 3. If there are not Class I legal heirs then you may become the sole owner; 4. For that you will have to obtain letters of administration from the court; 5. Consult a local lawyer, with full facts and then take steps.

You can apply for succession certificate in competent court. After getting succession certificate you can submit to the society.Thereafter society can transfer flat on your name.In succession application you can add additional properties.
