Since your sister is refusing to acknowledge your 50% ownership despite your financial contribution, here’s how you can proceed legally: 1. Gather Proof of Your Contribution Bank statements showing your 30% payment towards the flat. Any written communication (emails, messages, or chats) where you both discussed the ownership. If there were any verbal agreements, try to get witnesses who can confirm it. 2. Send a Legal Notice A lawyer can send a formal legal notice to your sister demanding recognition of your 50% share. The notice should clearly state that you contributed 30% and are willing to pay the remaining 20%. If she ignores it, this document will strengthen your case in court. 3. File a Civil Suit for Declaration & Partition If she still refuses, you can file a declaration suit in the civil court to establish your ownership. Since you are co-owners by financial contribution, you can also file for partition of the property. The court may order your name to be added or direct her to either sell or compensate you fairly. 4. Injunction to Prevent Sale or Transfer If you fear she might sell or transfer the flat, you can file an injunction suit to prevent any sale until your share is legally determined. 5. Mediation as a Last Attempt If possible, suggest mediation through a legal mediator to resolve the matter without litigation. What You Should Do Now: Collect all financial proof of your payment. Send a legal notice demanding your share. If ignored, file a suit for declaration & partition. Consider mediation if your sister is willing. Would you like help in drafting a legal notice or filing a case?
