Flat given by promoter want to give it in gift deed how to proceed

My mother was the owner of the land and we gave it to the promoter. We got flat and garage from the promoter. He gave us a possession letter on his letter head with signature. Now my mom is wishing to gift it to me so that I can get education loan. Can the registered gift deed be done? Or first we should register it in my mother's name then approach for registered gift deed? We are a Hindu family. I am the only child.What should we do?

First of all, the legal instrument through which the promoter was vested with the right to construct the building on your mother's Landed property is to be examined.Conditions precedent to handover the possession of the land to the promoter is the key factor in respect of your mother's ownership​ right to the apartment.If you so desire, you are most welcome to consult me through lawRato.

Yes the registered gift deed can be done directly in your name. provided the development registered agreement and flat/ratio allocation agreement as provided and executed between your mother and the developer is with you (your mother) which needs to be mentioned in the gift deed for gift deed
