Flat cancelation after possesion letter recieved

Property is in noida, galaxy gaur city, booked in aug 2016, basic ammount is 41lakh, Already paid 25lakh to the builder at the time of booking, recived possesion letter 6 month back, but Due to some reason I am unable to pay the rest ammount and I want to cancel the flat, but builder is saying they will deduct the 10% of the flat cost + 1 lakh service tax, due to which I am in loss of 5lakh rupee, Can I get my money back please help.

for that need to study Builder buyer agreement and Brochure what are their clauses and to know how more about things then you can file complaint in RERA court Noida. You also can approach a Lawyer for guidance what relief you could get

yes, if there is delay in completion of the project you can file a case in RERA. presently you at a loss of Rs. 5 lacs and if there is delay then they will be bound to return your money with MCLR+1 % interest. eventually you will be at profit. kindly contact us for further details
