Fir due to not honouring Agreement to Sell
25-Sep-2023 (In Property Law)
I am a witness on an agreement to sell signed off by my sister to sell off her property. There has been a dispute with buyer not making any further payment s after biana due to which agreement date has expired. Now buyer has filed an FIR against my sister mentioning my name as well and indicating an attempt to cheat the buyer.Police has for now registered a case against my sister to investigate but since my name has been mentioned in the FIR as a co conspirator do I need to worry about anything.Property belongs to my sister and biana payment has been issued to her bank account and my role is only of a witness. For now we hv only applied for anticipatory bail for my sister.
The Fir States that the seller has cheated by not honouring the agreement and not sold the property and only intention was to take biana money and that the witness is also involved in the fraud by assuring a fair deal and signing up as a witness to gain confidence
Dear Sir,
It is advisable that u secure an anticipatory bail for your self as well, as you are named in the FIR. As your sister's application for anticipatory bail has been allowed, you can move an application on the rounds of parity.
Further, please file a Petition under Section 482 of the Code of Criminal Procedure, 1973 before the High Court seeking quashing of the FIR against you.

Since your name has been implicated in the FIR as a conspirator, you should take it seriously. You should immediately seek anticipatory bail from sessions court and file a quashing Petition in the high court at the earliest. It will entail a lot of trouble if not taken seriously at this point in time. You may consult us for legal advice and services.
