Filing a suit to attach the property on legal owner

18-Jun-2023 (In Property Law)
In 1996 bought a property from legal owner. But in 1995 it was illegally sold to B. The seller got injunction order against B. Now like to settle it to my kids. I like to clear the encumbrance by B. Can i take action on my legal owner now(june2021).

In this case, of course you can I would like to know same person sold property to B who’s sold you and further perusal of documents guide you to step up the issues. I have a vast practice in that area you can seek my assistance in your matter.

Actually you or the legal owner has to approach the court to cancel the sale deed of 1995 and it cannot be overlooked. Then only the entries in the EC will be complete and your children will be able to enjoy the property peacefully. Otherwise there will always be shadow of doubt.
