In a partition suit, you can request the court to grant an interim injunction to stop construction on the ancestral property until the partition is finalized. *Interim Injunction Application*: You can file an application under Order 39 Rule 1 and 2 of the Code of Civil Procedure (CPC) seeking an interim injunction to restrain the other parties from constructing on the property. *Court's Consideration*: The court will consider the following factors when deciding on your application: - *Prima facie case*: Whether you have a strong case for partition. - *Balance of convenience*: Whether granting the injunction would cause more harm to one party than the other. - *Irreparable loss*: Whether allowing construction would cause irreparable loss to you. *Court's Order*: If the court grants your application, it may: - *Issue an injunction order*: Restraining the other parties from constructing on the property. - *Direct the parties to maintain status quo*: Until the partition suit is finalized. *Next Steps*: Consult with your lawyer to draft and file the interim injunction application. They can guide you through the process and represent you in court. Relevant laws: - *Code of Civil Procedure (CPC)*: Order 39 Rule 1 and 2 (Temporary injunctions) - *Specific Relief Act, 1963*: Section 37 (Temporary injunctions) Would you like more information on the partition suit process or guidance on drafting the interim injunction application?
