Fighting between brother and sister at present of father
02-Aug-2023 (In Property Law)
can a property be sold by court by auction in case of co sharer?
There can be many situations where the co sharers cannot agree between themselves as to the selection of purchasers or consideration amount. In that case a prayer may be made before the Court having jurisdiction for appointment of special officer or receiver for the purpose of doing the same. All the best and regards
In case of co-sharers, at least one of the co-sharers need to approach the Court for the purpose of claiming his share and getting it partitioned by metes and bounds. If the Ld. Court decides that the property cannot be divided, the Court can order sale of the property.
