Father transferred the property to step brother what can be done

18-Jan-2023 (In Property Law)
My father has sold his agriculture land and home to my step brother. because my step brother was saying if he does not do so, he will commit suicide at home or will arrest them in a fraud case. Agriculture land was an ancestral property. Now property has been registered on my step brother's name. So i want to know can I get that back or not and if yes what is the best and secure procedure.

you can not get back the agriculture land and home because your father has sold the agriculture land and home to his step brother through sale deed. Sale deed has been completed. If your father transferred the property by other means , you have a efficacious legal remedy for getting equal share from ancestral property, but sale deed not stop to any person for doing so.

If the property is ancestral then you can claim your share as coparcener. You need to file a civil suit for partition and get the name changed in the previous name in records so that your brother can not sell of the property during the pendency of the case.
