Father having medical problem being his nominee wants to sell property
27-Nov-2023 (In Property Law)
My father presently 88 years old has a property which he had decided to sale. I am his only child and this property being under co-operative society I have been named as his nominee . Problem is that suddenly he has sufferred a major medical crisis, & has completely lost his mind suddenly. The buyer is not ready to wait, what can i do ?
You can do a power of attorney in your name and then you can sell the property. You can consult with an Advocate and tell to make a power of attorney so that you can sell out the property without the presence of your father.
Sir
There is a contradiction in your own statement. 1. Your father wants to sale his property and 2. Your father completely lost his mind. Both cannot stand together.
Hence, it is not clear, ambiguity is therein. Now, I want to know on whose interest he wants to sale the property.
If a person lost his memory then in such case the permission from the Ld. District Judge is necessary.
Thanks
