Family partition in which one of my brother do not wants partition

We are hindu and marwari agrawal. We are seven brothers with a landed property of 1.10 acre with partly constricted house on it. one of my brother no 5 donot want partition because he is using more than his share.when we all six created pressure for partition he went in civil suit and there we gave him 1/7 share in property according to his demand in his plaint. The court passed judgement within a month saying that your plaint approved as it was. But he was of the view that in civil suit it will take years to decide. He is a decree holder even than he went to highcourt and mention there that the defendant are ready to demolish my shop. I will come on road and succeeded to get status co..Now what should we do to vacate status co. Please guide in this regard and expected time to be get order.
