Encroachment by erecting shed in front of house and on public land

12-Aug-2023 (In Property Law)
My neighbour, residing on the first floor, has built illegal sheds on the wall of my ground floor home (to park his cars). These sheds have blocked the entire front of my home and a large chunk of a public road. Do I have any authority to dismantle it and free my home's walls?

Yes you have all the remedies to get it removed as its a illegal encroachment ,therefore you can even ask for damages. Therefore you can file a civil case in competent court of law seeking damages and restraining any further act of the person, as well as inform the concerned authorities about the illegal act. Therefore you can even file a police complaint for the same.So both civil and criminal remedies can be exercised.

You are advise to issue a legal notice through lawyer for reatoring the easement right by removing the said illegal constructions. Please also file a complaint before concerned municipal corporation for initiating appropriate legal action and also asked to provide the approved map of said construction. Please also file criminal complaint and also initiate civil suit for restraining his illegal acts.

In this case you can first report to police via an FIR and then if they don't take any action then you can file a complaint case in the competent court. Please feel free to contact me if you want any further assistance.
