29-Jan-2023 (In Property Law)
We bought a plot 6 years ago. And we constructed house and we are paying tax. Now at the time of taking advocate asking the pattatayam. For verification. Unfortunately the first landlord he is in abroad. He have the pattayam. But not accesable because nobody in his family. In aadharam its clearly mentioned there is no original pattayayam or aadharam because we are buying portion. And we took loan from Co operative bank. All shown in the encumbrance. What should I do. Normally, immediate prior deed is required for a loan whether it's pattayam or sale deed. since it's not handed over, you can try to get a copy from the land tribunal from where the same is issued. If that is also not possible, an affidavit and indemnity stating the reason can be taken by the bank from you and clear the loan.
