Do the Co-operative Court have power to decide about forgery or not

10-Dec-2023 (In Property Law)

I disputed a resolution, at Co-operative Court, fabricated by Society allegedly signed by 9 members, wherein my signature is forged. Other 8 members neither come to court to give evidence nor Court summon them. Court held since other 8 members do not deny about their signature, therefore WHOLE document cannot be said to be forged & fabricated. (a) IS THIS FINDING OF COURT IS TRUE? (b) The settled principle "Fraud vitiates everything" cannot be applied? (c) Do the Co-operative Court have power to decide about forgery or not?

co operative court has no power to decide forgery but can give its finding about the same. in your case interpretation is misunderstood. court is not giving verdict neither it is criminal case so whatever findings are given ...within its power ... not the verdict of criminal case.... you can file criminal case before concerned court for the offences of forgery .
