Under hindu law every coparcener has right to partition and entitled to a share on partition. Under hindu succession (amendment) Act 2005 even daughters are entitled to a share in property .it is applicable on or after 2005. When division takes between brothers after partition they will take equal share in the joint family property. Partition may be by agreement, by arbitation , by father and by suit. You can go for legal division.
