Dispute regarding grandmother's property.

This is with regard to my house that we are staying, the property was initially with BBMP and in the year 1985 BBMP asked us to buy this. It was initially registered in my Grand mother's name. In the year 1986 my Grandmother wrote a will in the presence of the magistrate on my Mother's name. She died in an accident the same year. The will was probated in the year 2002. The tax has been paid by my mother since then and all the house documents are in my mother's name. Now my mother's sister has sent a lawyers notice stating that she needs 1/3 of the property. What are the legal implications?

as per the situations you have mentioned in your query . the property will be treated as the absolute property of your grand mother , which gives an absolute right to her to dispose the property as per her wish . therefore the will executed by your grand mother is valid. and as per the will of your grand mother the property is now transferred to your mother and your mother is now the absolute owner.

therefore , your mothers sister has no rights over the said property .

See contents o the notice sent by your mother`s sister. It is too simple to say that house is in your mother`s name and tax is also paid by her.When disputed the title does not depend on who paid taxes or whose name it is in.

there was no BBMP in the year 1985 first you have to clarify and how your grandmother acquired the property from competent authority and clarify payment of consideration she paid to the authority or she acquired free site from the authority. why she made WILL before the magistrate in your mother's name?
