Dispute of property with brother
09-Aug-2023 (In Property Law)
I started keeping my livestock i.e. cows and baffalows in an empty plot which belonged to gram sabha in 1985. after 13 years I constructed a house on that plot and started living. I gave GPA to my son in 2001 regarding the same plot. We decided to take a loan on the plot so to get it registered my son sold it to my wife. My wife sold the plot in 2005. My brothers filed an FIR in 2013 that the plot we sold was an ancestral property. they filed a case u/s 156(3) and asked for the police investigation. The police made an investigation but my brothers could not submit any proof that it belonged to our father. As burden of proof lies on the complainant and they are not able to submit anything. what will be the further process.
Since the complainant is not able to prove that the plot belonged to your father and police submits its closure report with the remarks that no such ownership proof of the said plot in the name of your father, the Hon'ble Court will dismiss the case and no FIR will be registered against you. Dismissal of case depends upon the the submission of closure report by investigating agency.
Hi first of all the proof of the all the gpa which has been done has to be shown in the court where they will see all the records which have been shown where they can see how the police had done with the complaint then u can file a case or complain against them
