Dispute between 3 trustees of a family trust
22-Apr-2023 (In Property Law)
Is it possible for one trustee to sell his part of the area in the property owned by a family trust? There are 3 trustees (cousin brothers)
If the family allows each trustee to divide and sell their share of the property being and owned by them then the sale of that particular share can take place however if the family trust does not allow the owner to sell their share then no sale can take place without the prior permission of the family
No way, you can't sell directly. you need to take permission. first of all we need to see the trust document nature of property, cause of sell. I will advice you to consult with lawyer with whole paper and instructions.
A Trustee cannot sell the Property without the consent of the Property Owners & Beneficiaries. Otherwise, Either Beneficiaries or Property Owners can sue the Trustees. Moreover, for a Trustee, it is important to take the consent of other Trustees before selling a Property.
