Demand of diversion notice
18-Jan-2023 (In Property Law)
I have purchased flat in colony developed by builder and taken possession in Yr 2013. Yesterday I received notice for payment of Diversion amount. Please provide your guidance on applicable law/rule and amount to be paid.
No , diversion is the responsibility of the developer. After hand over it is the responsibility of the developer, you either pass on the notice to him , or send him a legal notice. or through your welfare society.
This is fault of builder/developer.
But, in present condition, all the occupants/owners of the flats will have to pay equal shares of the total diversion tax payable.
After that, all the occupants/owners can recover the amount paid respectively from the builder/developer by a civil suit.
Also, all the occupants/owners can file a complaint against the builder/developer under the RERA Act.
