Delayed construction by builder Jaycee Homes in Kashimira

Hello, I had invested in a project by Jaycee Homes in Kashimira called Bhagtani Riyo in March'13. Project was advertised to be ready by end of 2016 and I had to pay 30% (Rs.7,65,000) upfront. Allocation letter states that I should get paid 15% interest if the construction does not start in the first year. Three years down, I am being told that since the builder could not obtain land title, my money will be returned with interest but I will need to wait for another 15 months (so builder earns interest) which is a policy they did not add in the allocation letter. What legal action can be taken?

Hi there. Since the Builder has defaulted in keeping up with his commitment, he can be prosecuted under Maharashtra Ownership of Flats Act, 1963. You can choose to file a criminal complaint in form of FIR before concerned police station as per recent circular of Maharashtra Police Commissioner. Apart from the criminal complaint, you may choose to file a consumer complaint for getting the relief that you are looking for.
