Deed of Rectification need original or not
29-Dec-2023 (In Property Law)
Hi Sir/Madam,
There is a small spelling error in my name in the original agreement(sale of deed) of my new flat (which will be just handed over). I would like to execute the deed of rectification. But the problem is the original agreement is with the bank because it is mortgaged. Kindly advise if I can proceed with a copy or not. My builder is asking for the original document.
This is my response to you:
1. You will need to do a rectification deed;
2. Borrow the sale deed by giving the bank an undertaking stating that you are borrowing it for a specific time period and the same will be returned soon;
3. You will have to register the sale deed with the rectification deed;
4. Consult a local lawyer and take steps.
