DDA society asking for ground rent is it legal

28-Jun-2023 (In Property Law)
I am allotted flat 1100 sq ft in coop group housing society at patpar ganj, east delhi in year 2000. I did not get it free hold till now. Society asking me to deposit ground rent rs40000/= without giving any yearwise detail+intt etc. Society did not sent any intimation of its due. Rwa say ground rent is paid half yearly to dda for all flats even if they get it free hold and total rent is being recovered only from those who have not get it free hold as per society rules. How far this rule is acceptable in law? What action against raw be taken for not intimations dues each month/halfyearly

You are advise to issue a legal notice through lawyer and asked the details of ground rent and pay accordingly and another option to deposit the grounds rent which is dues on your part because your flat is now freehold and if there's any difficulty you csn file a civil suit in this relief

Dear sir sorry for a late reply ,The CGHS society as a general rule of law charges ground rent. But irrespective of that there are two questions when the flat was allotted to you was any ground rent pending at that point of time and Im sure since year 2000 you would have payed the ground rent before as well or no??Therefore the details of the ground rent has to be provided by the secretary of the society or the president ,you can write to them asking for certain specifications and stating your grievances how the rent is been charged on you.If no answer is given by them certainly we have a legal course for the same.
