Construction/renovation of house acquired through registered will

29-Jun-2023 (In Property Law)
I have 1 brother and 1 sister and my mother gave the whole house to me through registered will. After my mother's death I gave only first floor to my brother through gift deed. Can my brother stop me from making construction on ground floor like expanding my house from side(which will not restrict their movement to common areas like entrance etc) even though I only gifted the first floor ?

Hello, Since he is the current owner of the flat and the space which you have provided him by any mode of transfer he can definitely stop if he wants to. Either you can approach him and make him under your favour and do the necessary renovations

This is my response to you: 1. You have all right to construct and expand the portion of your house; 2. You will also need to know that your brother has right to use entrance pursuant to law of easements; 3. Consult a local lawyer and take steps.

as per your query since you are the owner Off the ground floor premises you can very well carry out the renovation work without changing the actual structure of the building. father you need to make sure that the renovation work will not affect the entire structure of the building in any way. please note that before carrying out any work are structural changes on the ground floor you need to take formation from this society and also from the concerned local authority for the same. regards
