Compensation of land acquired by NHAI
26-Dec-2023 (In Property Law)
I purchased a plot from developer in 2003, outskirts of Aurangabad. Recently, a portion of land acquired by NHAI for Highway development. Being we were residing out of state, couldn't get information, and developer also mis leaded us. Finally we approached to local NHAI officer, he sent us to BHU ABHILEKH department, and BHU ABHILEKH sent us back to NHAI for getting an official request from NHAI. When we returned to NHAI, officer handed over us a letter, to move to court for asking compensation. As per letter, our records were not considered, during exercise of preparation of compensation list, and whole land considered as a property of developer. However, we have valid registered sale dead in our favour and also my name recorded in 7/12.
Now, don't understand what to do? please advise what kind of action should we take?
You can file a Civil case against NHAI and developer shall be made a party to it. You can ask for compensation from NHAI and developer in the said Civil case. And you also file a cheating case against developer .
