Clarification on partition of property belonging to mother

My father & mother joint name plot (1 Katha 07 chatak ) deed. My father passed last 14 Year. Side plan & House plan done on Mather, myself and my brother names last year from Nagar-bazar Municipality . My mother will to share her " area" to me as a gift. Partition not done, it is possible do the partition. Because, I only going to construct house.
Yes she can gift you the share of her. You need to come to my office and consult with me for further assistance along with all the documents of the said property. You need to come as soon as possible so that you get a quick remedy.

yes partition is vide a partition suit in the competent court. if your mother wants to gift you her share then i would suggest you to make that first and then apply for partition. then you will get your share separately and accurately.

Surely partition can be done of total 8 chatak in your name, only if your mother does gift of her share in you favour, but if she does Will, you do not become the owner of 8 chatak before her death. So go for gift. Obviously partition can be done to avoid future dispute with your brother. All the best. Regards
