Challenging of court decree ex-party.

My nephew got an ex-party court decree from Civil court Karnal 2-3 years ago for an ancestral property located at Gharaunda based on another ex-party decree of 1979.

In general, in cases of ex parte decree, an application of setting aside of the Ex Parte Decree is filed before the concerned court within 30 days of being aware of such order. Secondly, if through such application the decree was not set aside then an appeal can be filed and in some cases a review may also be filed. However all of these provisions have set timeframe and rules. For your case in particular please get in touch for further legal advice.

u can challenge the exparte decree. with in 30 days as per law or if sufficient cause is shown for delay then delay can be condoned that you didnot know about it or similar issues. you didn't have knowledge or unaware, unable. then it is a good ground to challenge exparte decree.
