Case filed for selling property to another as full payment wasn't made
20-Jan-2023 (In Property Law)
Buyer gave me 10000 rupees as token amount for my land and we wrote on white paper at that time. Buyer said after 1 month he will pay 25 percent amount. But he didn't respond. After 2 days I selled my property to others and registered to them. After registration I got to know that within that month he file a case against me in court and gave a newspaper advertisement in local paper. I'm staying in other place. So I don't know about that notice and even I didn't get any notice from court before registration. If I get notice at this time. Should I have to respond to court notice. Because now that property is not on my name and I have registered to others.
Sir you have to file a case in court stating that you are not the owner of the property now and before filing of the case you have sold the property to some other people as the person has not complied with the contract
you can give a notice to the buyer as he is not responding stating that you are willing to refund the token advance amount of Rs 10,000-00 if the token advance is transferred to you through bank or else nothing to fear
You should be mentioned date of registration and date of case filing.
You should be attend court adjournments and you have to file your written statement (your pleadings), as otherwise, you are set exparte and the court will pass orders in favour of plaintiff.

Hello, here firstly, both are initially agreed and wrote a white paper for Rs:10,000/- as token amount for the land.
later if you are not executed any Agreement of sale and other bonds. you are no need to worry .
he has right for recovery of that the advance amount/interest claims only. not have any rights on land and other claims.
