Case filed by property owner daughter claiming it, property sold to us

15-Sep-2023 (In Property Law)
Actually in 2009 my father bought property from a man who purchase the same from his relative. The owner of property was an old man. Now after his death her daughter put claims on that property. The old man sell that property to his relative and that property is registered in registrar office. My bought the registered property in 2009. But due to old man daughter our registry was on hold coz she puts case in district court. After fight for six years we won the case and got our registry. Now we are selling the Same property to other one but again she files case in high Court for same. We are totally crapped between this all. We can't sell the property even we can't rebate the property. Please advice us what to do and how we can overcome from this problem.

I can understand the situation that you are in but thats how it is, some time is needed for procedure but if facts are right then there is a definite solution.
Before commenting further I need to examine on what ground that lady is hindering the registration and sale process mentioned in the plaint copy, accordingly we can suggest you.

Dear Querist,
The Plaintiff has preferred an Appeal against the Order which is in your favour. This is her right. Is there any stay on the Order of the lower court. even otherwise you cannot sell the property. You have an option to take loan on the property with the permission of the Court before which the matter is pending.

You must contest the case before the High Court. Having won once, you have a prima facie case in your favour. Complete advise can be given once the documents are provided. Also, the stay, if any by the High Court is to be vacated.
