cancellation of sale agreement

A flat buying sale agreement has been executed between buyer and seller for an under construction flat. time for completion is 16 months with full payment in that time. payment is construction linked and buyer has paid 30% in 3 months.
now, buyer not satisfied with performance and invoked cancellation clause by sending written notice and claims for refund within the cancellation and refund clause of agreement.
seller refusing to refund.
is this legal ? 1s 16 nonths wait required to go to court ?
