Cancellation flat due to flaws in construction how to get money back

I have purchased a 1500 sqft flat and availed a home loan and paying the EMI since January 2016. Balance to pay builder is 9 lakhs out of 61 lakhs. I refused to do the registration as the entire flat has seepage from flooring upto 2 feet, on seeing the condition of the flat will mildew & seepage due to the incessant rains. I want my money back and I do not want to register either. This matter has been informed twice to builder by email.No response.I am a salaried individual. What should I do?

Dear sir,
As per your query you can file consumer complaint before State consumer commission, you can file complaint, when builder has not given flat as per agreement executed by him and also you can file if there is any deficiency found.

E mail is ok for a begining, but you also need to send to him a formal notice trhrough an advocate giving a specific time to respond.Also , get one qualified engineer ( who can later testify for you in court) to certify the defects. You can appraoch Court/ Forum later.
