Can will be made for lease property

My father got sublease land from Tata steel on which doublestory house he built .He made awill .After his death l filed probate Opposite lawyer during cross examination say will cannot be made of lease property .

You have averred in your query that the then lease happened between Tata Steel and your father thereafter you have erected double story building over lease property. After the sad demises of your father you have filed probate case on the basis of Will. I would like to inform you that no one can change nature of agreement/ lease unless and untill it is enshrined in the agreement/ lease for modification. As per the law we can not change lease agreement into a Will without information of Lease Holder.
