Can we stop taking the death certificate copy can we file a case

Me and my sister are minor i am with dob 4-8-1999 my sister is of 21-7-2007 My dady is major My mother is dead does her property will go to dady property is without will Does death certificate of my mother cause loss of our property We are against the thought of giving death certificate of my mother to dady If we give the certificate he will change all the property Our fear is that if he will get another death certificate copy by any mean we cant imagine the future of me and my sister Can we stop taking the death certificate copy can we file a case on the act of taking the property without will by my father

Hello sir. I have perused your query. Since your mother has passed away intestate, her property will devolve upon her legal heirs equally. Your father cannot alienate the property to the detriment of you and your sister. Please let me know if you need any further information.

You should immediately file a suit for partition as you have equal right in the property and take a stay on the Property. Your father cannot take away your share in the property. if your mother did not make any will then all three of you have equal right in your mothers property! However, if you are minor then your father is your guardian and he has the right to take care of the property. Still you can get protection from court.
