Can we recover full amout of down payment paid to builder

Booked a flat with 20%down payment unable to continue as my husband is sick and unable to get home loan too. It is a unregistered sale and construction agreement signed on sep 2013. Now they company say they will repay only after 10% deduction of basic apartment cost that accounts to 50% of my down payment. They sent cancellation letter after 1 yr. All deductipn details r mentioned in the construction agreement.From tat date I'm negotiating with th em but no use. Is there any chance to get full repayment?

Check whether the flat has been booked by any other person, and if so,, when? Check if it corresponds with the cancellation letter. Also you will have to check the date of payment due from your end, and the date of the cancellation letter. Based on these aspects, it is possible to claim an extra settlement.

Madam,
Better you try to contact the builder in person and explain the situation of yours and try to get entire money paid, as far your version clearly says that, you have no other alternative to claim entire amount paid to the builder.
