Can we challenge for gift deed

My father gift deed his all property (ancestral) to my brother's name. can i challenge this in court? If yes then how much chances to give me 50% shares of this property.

Dear Querist,

Yes. You can. because all legal heirs have right to use and enjoy the ancestral property.

It also depends on various circumstances which must have arisen between you. Or any release of share or affidavit of relinquishing right.

This is my reponse to you:
1. Yes you can challenge the same in the civil court;
2. You will need to file a suit;
3. You will need necessary documents for that first;
4. Consult a local lawyer and begin the process

If it is an ancestral property then even you would have right on it. We can very much challenge the gift deed and make it nullify. Your father does not have the right to part away with the shares of ancestral property without consent
