Can the other siblings ask for their share in father's property

21-Jun-2023 (In Property Law)
Hello Sir, Can my two sisters ask for their share in a property that's after my Father's name and I'm currently staying at that place. I am a Hindu and all my sisters are married. I would truly appreciate your quick reply and be grateful to it . And I would also like to know the procedure involved in transferring the property's name which is named after my Father into mine. I will wait for a revert eagerly.

As per your query,

Prior to 2005 amendment in the Hindu Succession Act daughter could not claim their rights in fathers property. However after the amendment of 2005 daughter have the right to claim right in fathers property. If your father has expired prior to the amendment date i.e. September 9, 2005, then your sisters cannot claim their right in fathers property, however if your father has expired after September 9, 2005 they become a co-sharer with her male siblings.

If you want to transfer the property in your name, you need to obtain a Succession Certificate from the competent court, wherein all the heirs (including your mother) would be made party to the proceedings.
