Can successors claim ancestral property after 15 years?
14-Nov-2023 (In Property Law)
We had a land ( ancestral property, which was not partitioned), my father and his brothers sold that in 2005 to third party without consenting me and my brothers. At the time of sale we were minor but still they did not take behalf signature and court permission for minors.
We are 4 grand sons thinking to file a suit against this sale and claiming our share now in 2019.
Please some one advise us, shall we file a case now and get our share back
If the property is ancestral then while executing the sale deed, all names of minors has to be mentioned being represented by their father/natural guardian. However if the same had not been done then you can file the suit claiming your share. However let me know when you or the youngest amongst you attained majority.
Kindly contact for further discussion as you might have a good case on your side.
