Can staircase of joint property be claimed by individual legally?

The staircase of our house comes on the jointly brought area, but the staircase made by a single and othera use it free. Can the individual claim the amount at least half of the amount of making from the other user legally?

Dear client,
As per the details given by you I would like to suggest that it totally depends upon the recital of the deed and rights of user as described in the said deed pertaining to the property and right to use of the said staircase if its the exclusive right then its different case and if its common right then its different case.

As the property is jointly owned and there are common areas, where the cost incurred must be contribute jointly.
As one person has invested for any joint purpose and using and deriving benefit by both, the person who have incurred cost can claim the cost.
Firstly you verbally ask for the payment, then write a letter with your documents for your claim if no fruits happen then send a legal notice.
