Can son of tenant claim compensation over my property sale

06-Jul-2023 (In Property Law)
I rented my shop 15 years ago to an aged man. 3 months ago he died and the court gave permission to his son to inherit the property citing to some hindu family law despite the property papers being held by me (I wasn't present in the court). He isn't even paying the rent and i fear a lawsuit would drag for years. I considered selling it but that he says that he needs compensation for the property which is more than the value of the shop! What do i do?

Tenant has no right to get compensation legally. As owner of the shop you must enforce your rights get it vacated and then only sell the Proprty. You file case against tenent to evict him for the reasons that you need the property.

Hi,

You need to file the suit for eviction, there are many grounds on the basis of which you can file the suit for eviction of tenant be it bonafide need, non payment of rent or the son of the tenant has no bonafide requirement ect ect..you need to contact the lawyer and can go for summary suit in which in few months you can get the shop evicted in few months.

Thanks
